My Ardon terms of use

These Terms of Use apply to individuals who enroll in or use My Ardon provided by Ardon Health. By creating a My Ardon account, you agree to the Terms of Use described herein. Please read these Terms of Use carefully before using My Ardon.

My Ardon user responsibilities

My Ardon is intended for use only by Ardon Health’s patients. Ardon Health reserves the right in its sole discretion to suspend or ban users at any time and without notice for any unauthorized use of My Ardon or any abusive, disruptive, or prohibited activity or behavior. Users are expected to use the My Ardon portal in a responsible and lawful manner. The portal may only be used for your personal healthcare purposes. Any attempt to access another patient’s information, submit misleading details, or misuse the service is strictly prohibited.

You agree to provide complete and accurate information when creating or updating your My Ardon account and to maintain the confidentiality of your login credentials. You are responsible for any activity conducted under your account and for ensuring that your device has appropriate safeguards in place to protect your information.

Privacy and security

Your use of My Ardon is subject to Ardon’s notice of privacy practices as well as state and federal privacy laws, including HIPAA. Ardon uses administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of your health information. You are responsible for maintaining the privacy of your login credentials, and updating security settings on your devices. You agree to notify Ardon Health immediately if you believe your account or personal information has been compromised.

By enrolling in and using My Ardon, you consent to Ardon Health collecting certain data and information about you and your device. We collect any content or images you send to us. We will not sell your data or information. We will not share your data or information with any third party without your prior consent unless the disclosure is required or permitted by law. The data and information we collect will be retained for as long as required by law or company policy.

Communications

You may receive communications from Ardon Health by text message, email, or phone call, depending on the communication preferences selected within your My Ardon account. These communications may include reminders, updates about your prescriptions, or other information related to your health care. Standard text message and data rates from your mobile carrier may apply. You may change your communication preferences or opt out of receiving certain types of communications at any time by updating your settings within My Ardon or by following the opt-out instructions provided in the message.

Copyright and Trademarks

All items on My Ardon, including, but not limited to, the design, content, text, graphics, pictures, information, data, software, sound files and other files remain the property of Ardon Health or its contactors, and are protected by United States and international copyright laws.

A single copy of these items may be downloaded and/or reprinted by you solely for your personal and non-commercial use. Any downloaded or reprinted materials may not be altered in any way and must contain any copyright or other proprietary rights notices that were contained in the downloaded material.

Any other use of the material, in whole or in part, for any other reason is expressly prohibited unless prior written consent is obtained from Ardon Health. Any rights not expressly granted by these terms and conditions are reserved by Ardon Health.

"Ardon Health" and the names of all Ardon Health products and services referenced on My Ardon and in the text message and email notifications are the exclusive or registered trademarks of Ardon Health, including logos and trade names. You may not use any Ardon Health trademark in any manner without the prior written consent of Ardon Health. The names and products of other companies referenced on My Ardon may be the trademarks of their respective owners. Reference to any products, services, processes, or other information, by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation thereof by Ardon Health.

Warranty and limitation of liability

My Ardon, including information offered through the portal, and text message and email notifications are provided AS IS and AS AVAILABLE, without representations or warranties of any kind, express or implied. Ardon Health hereby disclaims all warranties and conditions with regard to My Ardon, content available on the portal, and text message and email notifications, including any implied warranties of merchantability and fitness for a particular purpose. Ardon Health reserves the right, in our sole discretion, to modify, replace, or cancel My Ardon at any time and for any reason without prior notice to you.

Ardon Health is not responsible for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising from your use of or inability to access My Ardon, text message or email notifications, or information provided through the portal. Your sole remedy for dissatisfaction with My Ardon is to stop using the service.

My Ardon should never be used for urgent or emergency medical needs. If you are experiencing a medical emergency, call 911 immediately. The information available through My Ardon is intended to support communication and access to services but should not replace the advice, diagnosis, or treatment of your healthcare provider. In addition, while we strive to maintain reliable access, the portal may be temporarily unavailable due to maintenance, technical issues, or events beyond our control.

Indemnification

You agree to defend, indemnify, and hold harmless Ardon Health, its parent, affiliates, independent contractors, service providers, consultants and their respective officers, directors, employees, and agents, from and against any claims, damages, costs, liabilities, and expenses (including, but not limited to attorneys’ fees) arising out of or related to  My Ardon, the content that you share, your conduct, your violation of these terms of use, or your violation of the rights of any third party.

Governing law

These terms of use shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Multnomah County, Oregon, for the resolution of any and all disputes arising out of or relating to My Ardon and text message or email notifications.

Severability

If any provision of these terms of use shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the terms of use and shall not affect the validity and enforceability of any remaining provisions.

Future changes

At its sole and absolute discretion, Ardon Health may, at any time and without notice, add to, revise, or otherwise change (a) the information contained in My Ardon, (b) the products and services described through My Ardon, or (c) its terms and conditions. Any changes to the terms and conditions, or to the information contained in My Ardon shall be effective immediately upon posting in My Ardon. Therefore, you should frequently review the terms and conditions and applicable policies from time to time to understand how they apply to your use of My Ardon. Your continued access or use of My Ardon after such changes are posted constitutes your acceptance of and agreement to abide by such changes.
